Ground Rules

✧ Send all formal requests to [email protected] only. I will not accept official requests on my Instagram, however, I will respond to questions about commissions.✧ No refunds for completed art.✧ I have the right to decline any commission.✧ Paypal only.✧ Commissions used for commercial work (ie. merchandise for your business such as stickers/keychains/prints meant for resale) will have a +75% upcharge of the original price.
✧✧ I do NOT offer logos or branding kits on this account. Illustrated merchandise ONLY.✧ Prices may be customized due to the complexity of the requested piece (ie. detailed armor/costume, mecha/droid limbs,✧ If a proper reference cannot be provided, there will be an additional design charge to the flat rate for the type of commission requested. This charge can be from +15-75% depending on how much extra design effort is put into the commission.

Terms of Service

Introduction

Welcome to Banana Keiky's Commissions! These Terms of Service ("Terms") govern the relationship between Banana Keiky ("Artist," "we," "us," or "our") and the client ("Client," "you," or "your") in relation to the commissioning of digital artwork.BY ORDERING A COMMISSION (via successful payment) YOU ARE AGREEING TO ALL OF THE BELOW:

Commission Process

2.1 Inquiry: The commission process begins with the Client submitting a detailed inquiry via email or the designated contact form on our website.2.2 Payment: Upon acceptance of the commission, the Client agrees to pay the full amount of the total commission fee as a non-refundable deposit before work commences unless the invoice requests over $100. Then, negotiations on payment options can be made.2.3 Concept Approval: We will provide the Client with initial concept sketches or drafts for review and approval. The Client may request reasonable revisions at this stage.2.4 Final Delivery: Upon approval of the final artwork and receipt of the full payment, we will deliver the completed digital artwork in the agreed-upon file format(s) via email or file transfer service.

Payment

3.1 Pricing: Our pricing is based on factors such as complexity, size, and usage rights of the artwork. A detailed pricing breakdown will be provided upon inquiry.3.2 Refunds: The non-refundable deposit covers the Artist's time and effort invested in the commission. Refunds for the deposit will only be considered if the commission is canceled by the Artist due to unforeseen circumstances.

Intellectual Property Rights

4.1 Ownership: The Artist retains all intellectual property rights to the commissioned artwork, including the right to display the artwork in portfolios, social media, and promotional materials.4.2 Usage Rights: The Client is granted personal, non-commercial use rights for the commissioned artwork. Commercial use rights may be negotiated separately and require an additional fee.

Delivery and Revisions

5.1 Revisions: The commission fee includes three (3) rounds of revisions. Additional revisions may be subject to an additional fee.5.2 Delivery Timeline: We will provide the Client with an estimated timeline for completion of the artwork. Delays may occur due to factors beyond our control, but we will strive to meet agreed-upon deadlines.

Deadlines and Delays

6.1 Force Majeure: Neither party shall be liable for delays or failure to perform under these Terms due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, and government actions.

Confidentiality and Privacy

7.1 Confidentiality: We will keep all Client information confidential and will not disclose it to third parties without the Client's consent, except as required by law.7.2 Promotional Use: The Artist reserves the right to showcase commissioned artwork in portfolios, social media, and promotional materials, unless otherwise agreed upon with the Client.

Dispute Resolution and Governing Law

8.1 Resolution: Any disputes arising from these Terms shall be resolved through good-faith negotiation. If a resolution cannot be reached, both parties agree to mediation before pursuing litigation.8.2 Governing Law: These Terms shall be governed by and construed in accordance with the laws of California, without regard to its conflict of law principles.

Modification to Terms

9.1 Changes: We reserve the right to modify these Terms at any time. Any changes will be communicated to the Client via email or updated on our website.

Final Product
